Child & Parenting Issues
The more common of these include:
- Whether one parent relocates (intrastate, interstate or overseas) with a child and if so, the terms associated with the relocation
- Whether a passport ought to be issued to a child
- The terms upon which a parent should spend time with a child in the event they present a risk to that child
- Restraints which ought to be imposed to protect children from risk
- The provision of the child's medical, educational and religious needs
- Determining the parentage of the child
- Changing the name of the child
- Restraining parents from removing a child from the Commonwealth of Australia
- Causing a child to be returned from overseas pursuant to the Hague Convention
The Family Court is obliged to make decisions in the best interests of the child. However, determining what is in the child's best interest can be complex and is particular to the needs of each child.
Significant people in the lives of the child, such as grandparents, are able to commence or intervene in proceedings in the Family Court.
The lawyers at Klimek & Co have been involved in some of the most complex litigation in Western Australia with respect to parenting and child issues. We can assist in the negotiation and litigation of any child related issues.
