Parties to a marriage or a de facto relationship (including same-sex relationships) are entitled to seek ongoing financial support from each other. In some overseas jurisdictions this is known as "alimony".

Maintenance can be particularly relevant and urgent in the period leading up to a final distribution of property made by the Family Court.

Maintenance can take different forms including:
  • Periodic payments
  • Lump sum payments
  • The ongoing use of an asset such as a property
  • Compelling a party to meet certain ongoing expenses
The party seeking maintenance must not be able to adequately support themselves and the other party must have a capacity to pay such maintenance.

Although this is distinct from the property settlement between parties and any obligations with respect to child support, they are related.

Time limits exist for a party to apply for maintenance therefore, accurate and prompt legal advice should be sought.
